Terms

Terms of Service

The agreement covering your use of CallGauge — subscription, acceptable use, data ownership and liability.

Effective September 21, 2026

Agreement

These terms govern your use of CallGauge (the "service"), operated by Arktos Marketing ("we", "us"). By creating an account or using the service you agree to them. If you are accepting on behalf of a business, you confirm you are authorised to bind that business.

What the service does

CallGauge analyses call and job records you provide and presents performance dashboards, benchmark comparisons, revenue-at-risk estimates and per-call triage scores.

These outputs are decision-support estimates derived from the data you supply and from configurable industry benchmarks. They are not guarantees of revenue, and they are not a substitute for your own commercial judgement. Benchmark defaults ship as reasonable industry figures and can be tuned to your shop.

Accounts

You are responsible for the accuracy of your account details, for keeping credentials confidential, and for all activity under your account. Tell us promptly at the contact address below if you believe an account has been compromised. Owners and admins control who else can access a shop’s data.

Trial, fees and cancellation

New accounts include a 7-day free trial. After the trial, the subscription is $97 per shop per month, billed automatically to your payment method until cancelled.

  • You can cancel at any time from the billing portal. Cancellation stops future charges and takes effect at the end of the current paid period.
  • Fees are billed in advance and, except where required by law, are non-refundable for partial periods.
  • If a payment fails, the account enters a short read-only grace period before access is suspended. Your data is retained during that window.
  • We may change pricing with at least 30 days’ notice to account owners. Continued use after the change takes effect means you accept the new price.

Your data

You own the call, job and customer records you put into the service. You grant us only the licence needed to host, process and display that data to provide the service to you.

You are responsible for having the legal right to collect that data and to send it to us. If you upload call recordings or transcripts, you are responsible for complying with the recording and consent laws of every jurisdiction involved — including states that require the consent of all parties to a call.

Our handling of that data is described in the Privacy Policy, which forms part of these terms.

Acceptable use

You agree not to:

  • Use the service unlawfully, or to store data you have no right to hold.
  • Attempt to access another customer’s data, probe or bypass the tenancy and access controls, or disrupt the service.
  • Resell, sublicense or white-label the service without our written agreement.
  • Upload malware, or use automated means to place unreasonable load on the service.
  • Put real customer information into the shared public demo, which is a sandbox visible to other visitors and wiped nightly.

Availability

We work to keep the service available and to protect your data, but we do not promise uninterrupted or error-free operation. We may perform maintenance, and we may change or discontinue features. If we discontinue the service entirely, we will give account owners reasonable notice and an opportunity to export their data.

Warranties and liability

The service is provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total aggregate liability arising out of or relating to the service is limited to the fees you paid us in the twelve months preceding the event giving rise to the claim.

Termination

You may stop using the service and cancel at any time. We may suspend or terminate an account that breaches these terms, that we are legally required to suspend, or whose fees remain unpaid after the grace period. On termination you may request an export of your data as described in the Privacy Policy.

Changes to these terms

We may update these terms. If a change is material we will update the effective date above and notify account owners by email. Continuing to use the service after that means you accept the revised terms.

Governing law and contact

These terms are governed by the laws of the State of Missouri, United States, without regard to its conflict-of-law rules, and the state and federal courts located in Missouri have exclusive jurisdiction over any dispute.
